Filipe de  Vasconcelos Fernandes (Senior Consultant) is quoted in an article in Jornal de Negócios on the decision of the Constitutional Court that considered rules of the State Budget for 2016 contrary to the Constitution, by having an interpretative nature, and therefore implied a retroactive application which is not allowed.

On the interpretative rules that the Constitutional Court dismissed for considering them retroactive, the lawyer says "they are used, as a rule, for situations in which the previous solution was controversial, was not certain and, even so, fits within what would be a reasonable interpretation of the law".
