António Magalhães Cardoso talks to Público and Jornal de Notícias


The Portuguese Government has approved a law proposal that foresees separating technical authorizations for entering the market from patent litigation issues, say Público newspaper and Jornal de Notícias newspaper in their 9th September and 3rd September issues, respectively. However, Vieira de Almeida & Associados (VdA)'s partner from the Intellectual Property area of practice António Magalhães Cardoso, states that this can be an "unconstitutional measure", quote both newspapers. This is the result arising from tension between generic medication companies wishing to enter the market and patent holding pharma companies. However "patent rights are fundamental rights and Public Administration must be aware that it cannot incur in violating such rights", states António Magalhães Cardoso, quoted by Jornal de Notícias.
