Mozambique: Comprehensive Reform of the Insurance Legal Framework

The Government of Mozambique has enacted a comprehensive reform of the legal framework governing the insurance sector through two complementary pieces of legislation: Law No. 4/2026 of 21 January (which entered into force on 21 April 2026), which established a new supervisory authority, and Decree-Law No. 1/2026 of 30 July, which approved the new Insurance Legal Framework (Regime Jurídico dos Seguros).

The new regime was enacted pursuant to Law No. 6/2025 of 15 December (the enabling legislation) and repeals in full the previous Decree-Law No. 1/2010 of 31 December, which will remain in force until 27 October 2026. The new Insurance Legal Regime is expected to enter into force on 28 October 2026 (90 days after publication). Implementing regulations are to be adopted within 90 days of the publication of the relevant act.

A new supervisory authority (ASFPM) replaces the former ISSM, IP, with an expanded mandate covering insurance, reinsurance, mediation and prudential supervision of pension funds. Minimum share capital requirements for insurers have been significantly increased.
