The chapter outlines how the right of popular action has deep roots in the Portuguese legal tradition, from the Ordenações and liberal Constitutions to its contemporary constitutional enshrinement. The authors analyse Article 52 of the Constitution, which establishes the fundamental right of popular action, and Law No. 83/95 of 31 August (the Popular Action Law), which regulates the exercise of collective actions in Portugal, identifying areas of application such as environmental protection, public health, consumer rights, and cultural heritage.
