Guilherme Oliveira e Costa (Associate) has written an article published in EU Law Live, entitled: "The Court of Justice protects the concept of 'undertaking' and extends Intel's test to exclusivity clauses: Unilever Italia (C-680/20)", in which he makes a brief analysis of the EU Court of Justice judgment of 19.01.2023.
(...) through this judgment the concept of 'undertaking' and the theory of the 'single economic entity' are protected, as they are not reinterpreted in a way that could interfere more significantly with the application of Article 101 TFEU. On the other hand, it is relevant for the purposes of effective competition law enforcement to see the effects approach initiated by the Court in the Intel judgment being developed and extended to non-price fixing abuses such as exclusivity clauses."
