Joaquim Pedro Lampreia, partner, was interviewed by the Jornal de Negócios about the extension of arbitration appeals before the Portuguese Supreme Administrative Court.

This measure provides that in the event of conflicting tax arbitration decisions the parties can appeal to the Supreme Administrative Court, increasing the parties’ respective guarantees. However, lawyers fear the appeal proceedings will overload the system.

The law was presented by the Portuguese Government in Parliament and will be scheduled for discussion by members of parliament. According to the tax law expert, “this solution resolves one of arbitration’s main problems, namely, diverging solutions, depending on the arbitrators appointed, which cannot then be made compatible”.
