Sofia Ribeiro Branco (Partner) writes an opinion piece for the Almedina Observatory on the Portuguese Legal Regime of Economic Administrative Offences (“RJCE”), a transversally applicable penalty system structuring economic activities in general.

“We are witnessing the creation of yet another special regime for administrative offences, presenting innovative solutions, some of which are difficult to reconcile with the general principles of the RGCO and the Portuguese Constitution. The RJCE is now the general regime applicable to several hundred administrative offences, making reference to the RGCO on any matter not provided for therein, which in turn refers to the Penal Code and the Criminal Procedure Code as subsidiary legislation.”
