Caio de Mello Ferreira contributed the chapter “Inspection, Compliance, and Enforcement (ICE) Structure in the Draft Regulations on Exploitation of Mineral Resources in the ‘Area’: Historical Development and Current Dilemmas” to the book Navigating the Deep: Legal Regime for the ‘Area’ and the Future of Ocean Governance, published by Springer.

The chapter, co-authored by the VdA lawyer and Lea Kolmos Weis, a lawyer at Gorrissen Federspiel, analyses the development of the inspection, compliance and enforcement architecture set out in the draft regulations on the exploitation of mineral resources in the Area under the United Nations Convention on the Law of the Sea.

The authors assess the current architecture against four criteria:

  • the powers conferred by the Convention;
  • the risks of regulatory capture;
  • lines of accountability; and
  • capacity issues.
