Intensification of the enforcement of EU and UN restrictive measures

Security Council have been approving restrictive measures, namely relating to the freezing of funds and economic resources, prohibitions on the provision of funds and economic resources, and prohibitions on entry into or transit through the territory of a Member State, as well as sectoral economic and financial measures and arms embargoes, which are applicable in all Member States.

In Portugal, the application and enforcement of these measures is regulated by Law No. 97/2017 of 23 August ("Law 97/2017"), which has now been amended by Law No. 72/2025 of 23 December ("Law 72/2025").

In turn, Law 72/2025 transposes Directive (EU) 2024/1226 of the European Parliament and of the Council of 24 April 2024 (“Directive”), on the definition of criminal offences and penalties for the violation of Union restrictive measures. The Directive aims to ensure that effective, dissuasive, and proportionate criminal sanctions are available for offences relating to the violation of such measures.

Finally, the Portuguese Parliament approved Resolution No. 3/2026 of 8 January, recommending that the Government ensure compliance with the Directive ("RAR").
