New Rules on Packaging and Packaging Waste towards a Low-Carbon Circular Economy

On 11 February 2025, the new version of the Packaging and Packaging Waste Regulation (Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024), which sets out general principles and circular economy obligations for EU Member States, enters into force.

The objective is to prevent and better manage packaging waste, replacing Directive 94/62/EC of 20 December 1994, by:

  • Establishment of new targets to increase the amount of recyclable and reusable packaging waste;
  • Definition of recharge goals for the takeaway sector; 
  • Minimization of packaging through the design and use of materials;
  • Ban on certain single-use plastics for food and beverages, including packaging used in the HORECA sector (Hotels, Restaurants, Cafes and Catering).

The new version of the Packaging and Packaging Waste
Regulation enters into force on 11 February 2025.

The Regulation also establishes rules on the sustainability information that must be provided on packaging, including labelling and marking.

It should be noted that this regime affects the entire packaging supply chain, as the new obligations apply:

  • to all packaging placed on the EU market, regardless of the type of material used and whether it is manufactured in the EU or in third countries;
  • to the entire life cycle of the packaging, from its conception to its end of life, including its use.
