Magda Cocco (Partner), Tiago Bessa (Partner) and Rui Gordete Almeida (Associate) wrote an article for Lexology, entitled "The new Portuguese law on electronic communications has been approved and a new wave of regulation has just begun", under the New Law on Electronic Communications (Law no. No. 16/2022, of 16 August), which revokes the previous Electronic Communications Law (Law No. 5/2004, of 10 February) and, in particular, transposes the European Electronic Communications Code into Portuguese law, finally putting an end to an extensive legislative process.
"Overall, the New ECL introduces a comprehensive, complex and detailed set of rules that closely follow the wording and objectives of the EECC. In fact, when compared to the EECC text, the topic where we can see the most variations is that of end-user rights, something that is not surprising, as this issue was the epicentre of the parliamentary discussions held during the legislative process."
