The Tax and Customs Authority (AT) recently clarified the new rules applicable to investments in research and development (R&D) under the Corporate R&D Tax Incentive System (SIFIDE). This clarification was analysed by Joaquim Pedro Lampreia in a Jornal de Negócios article entitled ‘Tax authorities reassure investors in SIFIDE funds’.
Joaquim Pedro Lampreia clarified that the changes introduced in May 2023 brought new restrictions with entry rules and producing effects that ‘could raise doubts’. However, the VdA lawyer says that the dispatch, issued about a month ago by the AT, ‘reassures investors and makes a very correct interpretation of the law, which should be welcomed, especially because the law is a bit misleading and could have led to misinterpretations.
