In this insight, the authors explore the concept of tokenisation as a way of financing infrastructure projects. ‘Tokenisation is a difficult concept to decipher from a legal point of view. It generally refers to the issuance of a digital asset (usually a cryptographic token) that purports to represent a real asset,’ the authors explain.
The article addresses the legal challenges of tokenisation and how different types of tokens - such as utility tokens, security tokens and Non-Fungible Tokens (NFTs) - are subject to financial regulations. In addition, the authors highlight how tokenisation can give access to new investors, increase liquidity and reduce costs, making the financing of infrastructure projects more efficient.
