Tiago Bessa was quoted in an article published by Jornal de Negócios titled “AI threatens the ‘ecosystem’ of intellectual property law”, where he comments on the challenges that artificial intelligence (AI) poses to intellectual property law, describing it as “one of the greatest legal challenges of our time”. Bessa emphasised that “technology has always put intellectual property to the test”, stressing that “AI is testing its very foundations”, in a reflection on the growing impact of automation on the creation and use of copyright-protected works.

He underlined that it is not surprising that “AI systems are growing rapidly because they add enormous productivity”. However, he warned that “these innovations raise new questions about their eligibility for protection”, pointing to the need to review copyright and industrial property regimes to keep pace with the speed of technological change.

The lawyer further reinforced the urgency of appropriate legal responses, noting that “it will be inevitable to adapt regulatory frameworks to an unprecedented reality in the legal world, for which existing legislation was not designed”. The remark became central to the debate sparked by the article, which also highlighted the complexity of machine learning algorithms and the role of system opacity in the difficulty of assigning authorship and responsibility.
