Sofia Ribeiro Branco has written an article, published in Jornal Económico, entitled ‘Reality Check’, in which she analyses the new Artificial Intelligence Regulation (Regulation (EU) 2024/1689), which aims to: ‘Promote the adoption of human-centred and trustworthy artificial intelligence (AI), while ensuring a high level of protection of health, safety and fundamental rights enshrined in the Charter (...) against the harmful effects of AI systems in the Union.’

In the article, she highlights the ban on the use of AI to assess the risk of criminal offences based on personal profiles, but questions the exceptions provided for: ‘This exception is not intuitive to interpret, and difficulties in application are anticipated.’

The author also reflects on the lack of restrictions for legal persons, warning that: ‘By changing the natural persons who occupy leadership positions in legal persons, their behaviour changes substantially.’
