The latest episode of the podcast “A Quem de Direito”, a partnership between Jornal Económico and VdA, analyses trends in corporate litigation, consumer protection and the importance of compliance in the prevention of disputes.
In 2024, VdA published the book A Prática do Contencioso ('The Practice of Litigation'), which brings together 18 articles written by the Litigation & Restructuring team, coordinated by Frederico Gonçalves Pereira, guest on this episode of the podcast.
During the conversation, the executive partner of VdA's Disputes & Restructuring group explains that ‘litigation, by definition, presupposes a divergence of views that a third party has to arbitrate - the judge. It is the end of the enforcement of the law’ This reflection leads to a debate on the speed of justice, which, according to Frederico Gonçalves Pereira, is inevitably conditioned by the adversarial principle: ‘it is a process that, because it involves different points of view, always takes time’.
The episode also explores different interpretations of the concept of swift justice, as well as other key issues for the sector, such as class actions, corruption prevention, new European regulations on producer responsibility and corporate compliance rules.
