Miguel Lourenço e Silva (Associate) publishes an article entitled “Arbitragem Societária: O Problema do Consentimento” in the Anuário do ADR Lab, published by the NOVA Dispute Resolution Forum.
The article aims to broach the issue of consent in corporate arbitration, by endeavouring to contribute to discussion on the binding effect of an arbitration agreement inserted in the bylaws of a company, through a resolution adopted for the amendment thereof by the required majority, vis-à-vis dissenting shareholders, acquirers of share capital and the members of the corporate bodies.
