Manuel Cavaleiro Brandão, Partner in VdA’s Labour Practice, has written an article for ECO entitled ‘The service commission in the draft labour reform: a (bad) surprise’, examining the proposed amendments to the regime governing service commission arrangements under the draft Labour Law Reform.

In the article, he analyses the proposed amendments to the rules applicable to service commission contracts, focusing on the impact of the changes to Articles 161 and 164 of the Portuguese Labour Code. Among the key issues addressed are the narrowing of the scope of this contractual framework, the reduced room for collective bargaining, and the introduction of new conditions for entitlement to compensation upon termination.

The article contributes to the ongoing discussion surrounding the labour reform, assessing the coherence of the proposed amendments in light of the historical development of the service commission regime and its role in structuring senior management and executive functions.
