Joana Reis Barata, Senior Associate, is the author of the book 'A Alteração da Qualificação Jurídica no Processo Penal' (The Amendment of Legal Classification in Criminal Proceedings), recently published by Almedina.

The book examines the different types of situations that may fall within the concept of a change in legal classification, analysing their specific features and proposing solutions that allow for an appropriate procedural approach in each case. Its central aim is to ensure that criminal proceedings are conducted fairly and equitably, safeguarding the rights of all parties.

According to the author, “Although changes to the facts have traditionally received greater attention in studies concerning the scope of criminal proceedings, this work seeks to demonstrate that changes in legal classification can be just as detrimental—or just as harmless—to the defendant as the former. The various situations encompassed by this concept are therefore analysed, with distinct solutions proposed depending on the nature of the change.”
