The use of artificial intelligence (AI) in the judicial system has the potential to increase the speed and efficiency of the courts, but it should never replace human analysis, warns Magda Cocco. The lawyer points out that AI can help in the processing of cases, automating administrative tasks and analysing case law. However, she recalls controversial cases, such as the COMPAS software in the US, which revealed discriminatory biases, reinforcing the need for strict supervision.
‘The European AI Regulation classifies the use of this technology in justice as high risk, precisely because of the impact it can have on the rule of law and fundamental rights,’ says Magda Cocco. The lawyer emphasises that trust in the judicial system depends on the responsible use of AI, ensuring that it remains a support for decision-making and not a substitute for the judge.
